Legal Rights of Photographers

The Bottom Line

Except in special circumstances (e.g., certain government facilities), there are no laws prohibiting the taking of photographs on public or private property. If you can be there, you can take pictures there: streets, malls, parking lots, office buildings. You do not need permission to do so, even on private property. Trespassing laws naturally apply. If a property owner demands you to leave, you must. But if a place is open to the public — a mall, office-building lobby, etc. — permission to enter is assumed (although it can be revoked). In terms of the law, trespass and photography are separate events; the former is illegal, but the latter is not. Only if the use of photographic equipment itself violates a person’s privacy (e.g., by using a long lens to look into someone’s private room) might it violate privacy law. Further, while people have a right of privacy, businesses do not except trade secrets.

Subject to specific limits, photographers can publish any photo they take, provided those photos do not violate the privacy of the subject. This includes photos taken while trespassing or otherwise being some place they shouldn’t be. Taking photos and publishing photos are two separate issues.

Risks
  • Photographers run a limited number of risks from taking and publishing photos.

  • If they publish photos taken while trespassing, any trespassing judgments against them could be increased if the judge(s) feel it was inappropriate to take those photos.

  • They risk being charged with intrusion if they use technology — e.g., long lenses — to access places where the subjects have an expectation of privacy.

  • Although it is not against the law, they risk losing invasion of privacy lawsuits if their photographs reveal private facts about people that are offensive and not newsworthy (e.g., showing a person purchasing anti-HIV drugs) when the people had a reasonable expectation of privacy. Jennifer Aniston’s suit against the photographer who published topless shots of her falls into this category.

  • As with libel, they risk losing lawsuits if their photographs place people in a false light, e.g., mislabeling a photograph in a damaging way.

  • They risk losing invasion of privacy lawsuits if their photographs inappropriately use specific person’s images for commercial purposes, e.g., stating that the mayor endorses a product by publishing a photo of him using it.

The details

Whether or not you can take or publish photographs is a matter of privacy laws. There are widely recognized to be four “prongs” of those laws — that is, four areas of which you can run afoul. Avoid them and you avoid civil and criminal penalties.

Prong 1 (while gathering): Unreasonable intrusion upon seclusion (e.g., trespass)
Prong 2 (if published): Unreasonable revelation of private facts (e.g., medical information)
Prong 3 (if published): Unreasonably placing another person in a false light before the public
Prong 4 (if published): Misappropriation of a person’s name or likeness.

So there are two separate questions with regard to publishing photos: 1) Are we allowed to take them? and 2) are we allowed to publish them?

While posting photographs for this page, I admit, there have been quite a few occasions when I'd just done an image search on Google and picked up a photo. So, what do you do with your blogs? How do you produce the pictures, if you at all do?

A Little Sneak Peek Into Latest Design Of "Shayon's Labyrinth" - Suggestions Expected

Remember my last post on update on the Labyrinth and when I'd informed about increased feed subscribers to this page where I was talking about giving this blog a new look? Well, I wasn't bluffing! The above pic is a new design that Ashwin just suggested that I could implement. Well, as far as I'm concerned, it definitely looks pretty good and futuristic but I'd rather prefer a planar look. I was thinking about joining the lines at the top and make the header look like a paper weight on the page. Or, I was also thinking of just making two sheets of rounded papers, one for the main posts and other for the sidebar and just keeping the header on top of them. If not, then we shall have to remove the gaps that have been created right below the header, in the above pic.

So, what do you say about it? Do you think our ideas are good enough? Or do you too have something to contribute? Do feel free to keep upping the comments count.

RSS Feeds: Should You? Shouldn't You?

I have been using Google Reader as my feed reader for quite some time now. I must have got almost 40-50 feeds that I read daily on my mobile phone. One of those blogs is "A Public Galaxy of My Thoughts", which is maintained by my dear friend Rathz, who normally prefers to write about the north-eastern sector of India, mostly Assam. I had noticed quite some time ago that he had not allowed his readers to read the posts on their feed readers. They are just supposed to receive notifications every time he makes an update. Well, I did visit him everytime I got a notification 'coz, after all, he's a dear chum. However, it finally got onto my nerves one day and finally commented about it on his last post. When asked for explanation, he says :

....regarding the feeds, i hav the settings as such..
i want to bring ppl to my page so tht they xplore into the previous posts.

I used to debate on whether I should let my readers taste just a whisker and lure them to my blog page or just allow them to read the whole post on their readers. Well, the very fact that Rathz simply refuses to allow his readers to read his works until they reach his page, actually jarred that old conflict of mine. I thought, why not try a market research on this topic? I myself am a newbie on the blogosphere. I felt, it's much better if I sought the answers from the gurus themselves. After quite a bit of scourging the net and overusing the Yahoo search bar, I did end up with some interesting points. While it was clear that majority of the population prefers full feeds, there are still a few who feel partial contents are the way to go. So, here I put forward all the advantages and disadvantages of full feeds at your perusal. It's upto you to decide, now, which way would you prefer.

Why shouldn't you broadcast complete content via RSS feeds?
  1. Most of the people feel that if they offer full feeds then no one shall ever bother to visit their pages, thus reducing their revenues from AdSense and other similar advertising programs.
  2. There are many bloggers who take every pain possible to make their sites look state of the art. Some of them feel discouraged if their designs and hard work go unnoticed.
  3. Actually, there are only above two (credible anough) points that I could figure out. :-P
Why should you broadcast complete content via RSS feeds?
  1. As far as advertisements are concerned, most people use AdBlock (with FireFox) or some other similar plug ins that enable the browsers not to load the advertisements at all. So, even if readers do happen to visit your page, they won't be checking out your ad links at all.
  2. If you are still keen to earn , you can always put up advertisements on your feeds.
  3. Since you allow bots and feed readers from various other sites to crawl into your content, you get more exposure and it even improves your rankings among the search engines.
  4. There are a lot of times when blog service providers are down due to maintenance. Well, feed readers are still able to download your posts and cater toy our readers.
  5. Most readers find it a PITA (pain in the ***) to have to click on an external link to be able to read your post, if you don't have your full feeds switched on.
  6. This one decides it all at the end of the day, I feel. Despite belonging to a developed society, continuous connectivity is still not a reality for a lot of us. Especially in cases of dial ups, where you need to pay by the minute, your readers would rather prefer to download all your updates at once and then read them offline, at their own leisure.

What a Wastage of Waste!

I had a lecture today evening, in college. The subject is known as OBIP or "Organizational Behavior & Industrial Psychology". The lecturer had commented something that have been getting me thinking for quite some time. Wanna give some thought to it? He said -

Nothing is a waste in this world. It is a waste because we don't know how to make use of it!

Ponderings...

He's Hurt, Mentally & Emotionally;
But everyday He walks outside with a smile on His face.
Because that's who He is,
The Guy who never stopped smiling!

And they said,
"If you endure the pain a little bit more ;
The pain will eventually, go away."

A Quiver Full Of Queries

Have you ever craved for something so bad that you’ve actually worked for a year n a half just for that? Whatever you’ve done, howsoever you’ve thought, everything for that ultimate goal? Have you ever consoled yourself, every time u had a bad day, that you at least you have a master plan that can negate a lot of your short comings? Have you ever slept blissfully knowing that the moment you drift off, u have a dream to soothe you off your day’s tiredness?

And now the bouncer – Have you ever seen that very dream dissolving right before your eyes? Have you ever gotten haunted by a mistake you’d made long back in your life, right in that very dream of yours? Have you ever experienced the pain it causes when u lose the very support system of your being? Do you know how it feels when you are aware that a single fig can help you from drowning, but you hands aren’t long enough to reach the nearest bunch?

I don’t know the kind of life you’ve lived. But I’d certainly love you to leave a few lines if you can answer a few of my queries. I’m asking you, ‘coz probably I don’t know the answers myself…or probably I do, just isn’t too easy for me to admit the same!

Just A Li'l Of My Idiosyncrasies...

Wow, now this is interesting. There have been times when I used to blog once/twice a day. And now, I'm down to once in a month. And that too, 'coz I get constantly coaxed by my girl friend, the only person I know who feels people actually wanna read what I write in here! Well, may the devil bless her!!

Seriously, life's been so bloody disorganized these days. My end semesters got over a week back, and yet here I am, rotting in this hole, hoping to lap up a good project for the winter. Well, I wish all the best to all who are trying with me. Hope our efforts don't go down the drain! And well, to top things up, screwed things a li'l bit with a friend of mine, last night. Then there are assignments et al to catch up on. Haven't been hitting the bed these days before 5 in the morning. Frequency's gone up to about 15 sticks a day. Have no idea when I have my food and when I don't. And then again, there's incessant power cut to screw things up some more. Is this the kinda life I dreamt of? Is this the kinda life I'd want to live? I don't know! That is the problem, I just have no clue where my life is heading to. The results are expected to be out in a few days...and I already know that I'm flunking in one of them. As for the rest, may the devil himself save me! Mom got operated a week back. And what am I doing here? Y am I even pretending that I wanna get my academic career back on track? Am I writing too much of personal stuff for the world to read? Well, I don't care...I don't give a flying fuck, anymore. I've been humiliated enough, I've been spit upon enough...I don't think I'd hardly care about some more. I know, there are still people in this cosmos who love me...I know there are people who still feel I have it in me to turn the tides....and u knw what the worst thing is? I feel so too. I just can't fathom what's stopping me from turning back...what's preventing me from demanding my dues! Can you? Do you know what the shit's going on in mah head? Do u think things can get better? Or have things gone beyond repair? What do you say?

My Life...!!

A forked path in this road I encounter,
As I tread alone in this journey called Life.
Putting one foot ahead of the other,
I have trudged so far -
Never thinking, never feeling, never living,
Just existing
In this hollow world that has been created for me.
But now, faced with a choice, I stop.

Taking an uneven breath for the first tme since I started
My journey of constants, constants thrust upon me,
I slowly look up.
Two divergent paths, two divergent roads
A choice that I can make for myself, at last.

I look at the two paths ahead of me.
The one to the right has all I yearn for -
Love. Hope. Warmth. Strength. Courage. Desire.
A home in a quiet place,
Someone to hold me in her warm embrace.
A beacon of amber light; my only salvation in this darkness,
Calling out to me - welcoming me, wanting me, warming me.
My eyes, alive and bright for the first time,
Turn to the other half of the fork.
Darkness - a cloud of never ending darkness shrouding the path
Looms ahead of me.
Colder than the devil's heart,
It chills me to the very depth of my soul.

Which one should I choose?
Although the answer should've been obvious,
With a sinking feeling in my stomach,
With a deep pain cleaving my heart,
My illusion shatter into a thousand pieces
And I am jarred back into my reality.
The stark realisation that
I cannot choose my own path;
Someone has already chosen it for me.

This truth, this profound knowledge, is the only truth in my life.
The glimmer of light, the flicker of hope,
Fades from my eyes as it does from my life,
And just as the weak bows down to the empowered,
I do, in acceptance of my fate.
My eyes, the windows to my soul, assume their normal state of emptiness.
Steeling myself for the never-ending, ever-losing battle that lies ahead,
I take a deep breath.
My life, with its constants & misery,
Settles around my shoulders like a well-worn cloak.
Looking around for the shards of my being,
I find none; this nothingness is all that is left of me.
Looking to my right one last time,
I draw on the last vestiges of my strength & forge ahead.
Further & further from the warm amber glow,
Deeper and deeper into the cloud with no silver lining,
Walking the path of my shattered hopes and dreams.
Welcome to My Life!!

Physical distance in a Relationship

How much of physical proximity is required for two people in love? Is physical touch at all necessary for two people who are very much in love? Confused why I put up such a question? Well, then allow me to let you in with some facts. It's just that me & my girlfriend, Sakshi, stay thousands of miles away from each other. I'm studying out here in Jamshedpur whereas she's from Delhi. Anyways, coming back to the point, there have been loads of times when we actually felt the physical distance between us. There have been hundreds of times when we craved just to be able to touch each other, just to be able to spend some time looking into each other's eyes.

Now, don't you misunderstand me! While talking of the distance in a relationship, I don't necessarily mean sex. Of course, we aren't saints. But doncha think, just to be able to hold each other's hands, just to be able to hug each other once in a while when the other is down, means a lot in a relationship? I've talked about this to quite a few of my friends. Although a number of them feel that it does matter, "purists" feel that if it's "true love", the distance chouldn't create any problem. If it's "true love", talking to each other for about half an hour in a week should be enough. You shouldn't need anything else if both of you know that you love the other more than anything. Now, the problems that I face here is that I get perplexed everytime I hear "true love". Frankly, how would you know if your love is true or not? And moreover, in today's world, do you really think just the knowledge that the other loves you, is enough for a relationship?

Personally, I'd love to hold my girlfriend's hands as often as I can manage, I'd love to give her a bear hug everytime she's down, would wrap my arm around her waist while we're walking together. I'd even love to converse with her with just our eyes. Could've cut my left hand off just to have occassional dinners with her. Nothing can beat the appreciation on how the newest shirt, that you bought yesterday, looks on you. I feel these petty things go a long way to make a relationship memorable & worth dying for.

I'm not sure if I'm right or wrong in my beliefs. Neither am I sure whether Sakshi's gonna approve of this post. Yet I published this 'coz I wanted to know what others feel, I wanted to know what you feel about the point I raised in this post.

So, what do you say?

50% Reservations - No, that's not for the Trains!

Well...for the uninitiated, the MHRD plans to hike the reservation of seats for the "backward classes" (that is, scheduled castes, scheduled tribes & other backward classes) upto 50%. They feel these minority sections of the society are the most undeprivileged and they certainly need a boost by the government to move ahead in their lives!

Well...I have a query here. Why the hell do the folks belonging these so called backward sections need to improve their own lives if they continue to get such obscene level of helping hand from the Government? I mean, c'mon...give the rest of the crowd a break! They've been offered reservations from time immemorial and yet, if they need some more to climb the social ladder, do youreally think they're really worth this advantage?

Okay, exactly what class of people are we trying to help, out here? Is it the underprivileged or the lower economic class or the ones who've already established temselves in the society? Underprivileged - how do we really classify who's underprivleged and who isn't? Is it their social position or the economic condition or how important they are in alloting votes? I agree, owing to reservations, this so called "backward secton" has risen to a much greater level..but isn't that enough? I think it's high time we left casteism behind our back and moved ahead. Let's face it guys, it's hardly helping the society in general. C'mon...you know what sorta feeling I'm getting? That the government has divided the very country into 2 sections, one's the forward section & the other backward class. And each of these classes has been given 50% of space to live in their motherland. One must know which half you belong to and better take care not to intrude in the other. This is so bloody incredulous!

I know, this topic is subjected to a very heavy debate whether reservations should b present or not. But here what I'm trying to get into the light is the question whether an obscene 50% reservation's required for the upliftment of the backward sections of the society. I feel the real backward sections of our society are the ones who still have to strive insanely just to have their meals twice a day, they r the ones who can't afford even the most basic neccessities of living. And don't you think such a section doesn't belong to just the so called government stamped backward class but also among the rest? Don't you think it'd have been more feasible and practical if our esteemes government could arrange for financial aids for the needy, built more institutes and tried to market education in the rural sections much fiercer to help the oneswho really need it? Do they think my next door Mr. Marandi, who probably earns 3lacs ina year and drives a Toyota Corrola, needs reservatios for his son to get admitted into a reputed college? Does the government feel that my friend Akshay, who had 3 laptops in his family of four and whom I've never seen coming to school in any transport other than a car, actually deserved the reservations 'coz of which he got Electronics & Telecommunication in NIT Trichy, with an all India rank of 1.2lacs and I deserved to be doing Electrical Engineering in NIT, Jamshedpur with an all India rank of 3,600? Is this what our elected officials call justice for the society?

Brain drain had always been a serious problem for India. Previously, the best of the minds used to go out to work 'coz of higher salaries and better prospects. Such a scenario could be made a thing of past by emerging of MNCs in the country and the standard salary increasing manifold. However, now it seems brain drain's now gonna be much more rampant owing to shortage of seats in the premier institutes such a law is gonna result to. But then again, I guess the government doesn't really care much about that. All they need is votes for their fast drying up vote bank. Kudos to you, mr Arjun Singh. Bravo for taking such an awesome move!

What should be the color of my Blog?

Your Blog Should Be Blue
Your blog is a peaceful, calming force in the blogosphere.
You tend to avoid conflict - you're more likely to share than rant.
From your social causes to cute pet photos, your life is a (mostly) open book.

Okay, this particular site says that my blogpage should be based on blue. Well...it's been quite some time now since I've been using this theme. What do you feel? Do you too think I should be having a blue theme to it? Or is the present one looks good enough? Do give me your views. If you think I should change it, I just might do so!

Astrology - What a waste!

Hmm...So, does this guy look anywhere like your family or the neighbourhood astrologer? At least I find them all pretty comic. I find it quite strange, how some people are so much concerned about what their so-called horoscopes say. It rather disgusts me to the utmost to find people actually planning their days according to some crackpot who'd prepared their janmpatri. What a waste!

Yes, it's true that I'm an Atheist. But does that have any bloody thing to do with believing and not believing in astrology & it's various tentacles? I just find it funny how some people give it all the importance of their lives. Okay, I'm not really thrashing the very art. It does have it's implications. I've had quite a few proofs of it's level of accuracy in my own life. But, correct me if I'm wrong, one is also capable of turning one's own fate by his deeds. I feel one should just go by one's own business, without thinking much about the future.

I know, I'm talking like a kid. But I'm just too tired right now to actually write properly. Probably I'll follow up later when I got some time in my hand. Just felt like writing up something right now after reading a post written by my girlfriend. I was too pissed to even comment to that.
